This document, hereinafter “Braintoys SPA Privacy Policy” or “Policy”, explains in detail the types of Personal Data we collect about you when you interact, directly or indirectly, with Braintoys SPA (hereinafter Braintoys).

It also explains how we use and safeguard your Personal Data, with whom we share it, what your rights are, how you can exercise them, our approach and how we respect your privacy, among others.

For purposes of this Privacy Policy, the words defined below shall have the meanings assigned to them in this section.

Authorization: The Processing of personal data by Braintoys requires the free, prior, express and informed consent of the Data Subject.

Company: Braintoys.

Processing: Any operation or set of operations on Personal Data, such as collection, storage, use, circulation or deletion. The revocation and/or suppression will proceed when, within the framework of the processing carried out by the Controller or Processor, conduct contrary to Law No. 19,628 and/or the Political Constitution of the Republic has been incurred.

Right of opposition. It is the right of the owners not to make use of the processing of their personal data or to cease the same in the event of a business relationship.

Right to data portability. The data owner has the right to request and receive from the data controller, a copy of the personal data concerning him/her in a structured manner, in a generic and commonly used format, which allows to be operated by different systems, and to communicate or transfer it to another data controller.

  1. What data do we collect?

We’re happy for you to share your personal information with us! We want to make your shopping experience with us as joyful, meaningful and easy as possible. To achieve this, we collect certain information about you, which will enable us to deliver the best service to you.

We collect information directly from you when you enter information on our services or send us messages.

The Brain Toys website obtains and records information from users in two ways:

A.- Automatic mechanisms: This refers to electronically executed processes with the purpose of generating records of the users’ activities on the site. It is not personal information that allows the individual identification of persons visiting the braintoys.cl site, but corresponds to general data of the visit made.

B.- Manual mechanisms: Refers to formal requests from users, who enter personal information to our website when creating an account or making a purchase, such as their name, surname, country, e-mail address, address, zip code, commune and contact telephone number. These data will be registered voluntarily by the users and Brain Toys will clearly indicate for what purposes they are being requested.

IT service providersWe may use our IT service providers for specific functionalities and hosting, who will process personal data on our behalf and on our instructions to ensure good and secure IT operations. We only share your personal data with our IT service providers if it is necessary for them to fulfill their obligations to us under the contract we have with them.

We also share your data with other business partners, who will be responsible for certain processing of your personal data. These business partners are:

  • Google: when you use the System and the Application, and give us your consent to do so, we will also share your personal data with Google (Google Analytics/ Google Search Console), which provides the service we use to analyze the use of the System and the Application and allows us to check the status of the indexing of sites on the Internet by the search engine and optimize visibility.
  • Microsoft: Microsoft offers a user behavior analysis tool (CLARITY), which allows us to capture user interactions on our website, such as how the page is displayed, user interactions such as mouse movements, clicks, scrolling, etc. This includes data such as IP address, browser type, length of visit and pages visited. We are not responsible for the information practices of such third party websites or applications, so you should exercise caution and carefully review the privacy policies applicable to any third party websites or applications that may be accessed through our site or services.

  1. Duration of data processing

Brain Toys will keep your personal data protected for the duration of the professional relationship and up to a maximum period of 2 years after its termination. Exceptionally, in case they are necessary as evidence in possible claims, they will be kept until the end of these.
